1. Purpose and scope
These terms and conditions of sale (hereinafter the “T&Cs”) govern, without restriction or reservation, all passenger-transport services booked through the website www.atafrance.com (hereinafter “the Site”) with the company TLCS, which operates the ATA France brand (hereinafter “the Provider”).
Any booking implies the customer's full and unreserved acceptance of these T&Cs (hereinafter “the Customer”). The Customer declares that they have read and accepted them by ticking the box provided for that purpose before confirming payment. The Provider reserves the right to amend the T&Cs at any time; the applicable T&Cs are those in force on the date of booking.
2. Provider details
The services are provided by Transport Logistiques Conseils et Service (TLCS), a French limited liability company (SARL) with share capital of €30,000, whose registered office is at 32 rue Paul Fort, 77330 Ozoir-la-Ferrière, registered with the Melun Trade and Companies Register under number 815 194 113. 3. Booking
Bookings are made exclusively online on the Site. The Customer provides the information needed for the trip: pick-up and destination locations, date and time, number of passengers and items of luggage, vehicle category and, where applicable, flight or train number.
A booking is final only once full online payment has been confirmed and the Customer has received a confirmation email summarising the trip details. That email constitutes the Provider's acceptance of the order. Until payment is confirmed, no service is booked or guaranteed.
The Customer is solely responsible for the accuracy of the information provided. Any error in the address, time or flight/train number that may affect the proper performance of the service remains the Customer's responsibility.
4. Price
Prices are shown in euros, inclusive of all taxes. ATA France applies a fixed price, known and displayed before the booking is confirmed: the confirmed price is subject to no night, weekend or public-holiday surcharge, and no increase linked to traffic or to the actual duration of the trip.
The price includes the transport of the Customer and their luggage within the capacity of the booked vehicle, pick-up at the stated address and, for airport and station trips, the waiting time set out in Article 7. Services not included in the booking (an additional stop, a route change at the Customer's request, waiting beyond the grace period) may be subject to a surcharge notified to the Customer.
5. Payment
Payment is made in full and online at the time of booking, by bank card, through our secure payment provider Stripe. No payment is collected on board the vehicle or by the driver.
Bank-card details are entered directly into Stripe's secure interface and are neither processed nor stored by the Provider. Transactions use the 3-D Secure protocol where the Customer's bank requires it.
No cash or cheque payment is requested by the driver. The full price is paid online at the time of booking. Any request for payment on board should be regarded as abnormal and reported to the Provider.
6. Vehicles and capacity
When booking, the Customer selects the vehicle category suited to their needs:
- Sedan / SUV — up to 4 passengers and 4 items of luggage.
- Minivan — up to 8 passengers and 10 items of luggage.
The Customer undertakes to book a vehicle category compatible with the actual number of passengers and items of luggage. If the capacity is exceeded at pick-up, the driver is entitled to refuse some or all of the passengers or luggage, without the Customer being able to claim a refund. Children are carried in accordance with the applicable regulations; the Customer indicates at booking any need for a suitable child seat.
7. Pick-up, timing and flight tracking
The Customer is ready at the agreed time and place. For pick-ups at an airport or station, the driver tracks the flight or train given at booking in order to adjust the arrival time in the event of a delay.
For this reason, for a return trip, the Customer must provide the return flight or train number, which is different from the outbound one: it allows the driver to track the actual arrival and be there at the right time.
A grace period is granted at no extra charge: it is intended to cover disembarking and baggage-collection formalities. Beyond this period, additional waiting may be charged. If the Customer is absent from the meeting point and has not been in touch by the end of the waiting period, the trip is deemed not honoured through the Customer's fault (see Article 10).
8. Right of withdrawal
In accordance with Article L.221-28, 12° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to passenger-transport services provided on a specific date or with a specific frequency.
By confirming the booking, the Customer expressly acknowledges that the service, performed on the agreed date and time, does not give rise to a right of withdrawal. The applicable cancellation terms are those set out in Article 9 below.
9. Cancellation and changes by the Customer
The Customer may cancel or request a change to their booking by contacting the Provider at contact@tlcs.fr or on +33 1 30 33 10 56. The applicable financial terms are as follows:
- Cancellation more than 48 hours before the scheduled pick-up time: full refund of the amount paid.
- Cancellation less than 48 hours before the scheduled pick-up time, or Customer no-show: no refund is due, as the slot and driver had been reserved.
This 48-hour period allows the Provider to reassign the driver to another job. Any change (time, address, vehicle category) remains subject to availability and may lead to a price adjustment.
Alternative to a refund: instead of a refund, the Customer may opt for a credit valid for 12 months from the cancellation date, usable on any new booking. This more flexible option applies to late cancellations too and is offered at the Provider's commercial discretion.
10. Customer no-show
A no-show is any situation in which the Customer does not appear at the meeting point at the agreed time and by the end of the waiting period, without having notified the Provider or their driver. In that case, the service is deemed due in full and gives rise to no refund. In the event of difficulty or delay, the Customer is encouraged to contact the driver or the Provider without delay so that a solution can be found.
11. Customer obligations
The Customer undertakes to:
- provide accurate and complete information when booking;
- be at the pick-up location on time;
- behave respectfully towards the driver and other passengers;
- respect the vehicle and its equipment; any damage caused by the Customer is their responsibility;
- comply with the rules in force on board (wearing seatbelts, no smoking).
The Provider reserves the right to refuse or stop a service in the event of dangerous, aggressive or unlawful behaviour, without refund.
12. Liability
The Provider is bound by a best-efforts obligation in performing the transport service. It cannot be held liable for delay or non-performance resulting from force majeure, exceptional weather conditions, traffic disruption, strikes, or inaccurate or incomplete information provided by the Customer.
The Provider cannot be held liable for the consequences (missed connection, missed flight or train) of a delay not attributable to it. Luggage and personal belongings remain under the Customer's supervision and responsibility throughout the transport.
13. Complaints and consumer mediation
Any complaint about a service must be sent to the Provider at contact@tlcs.fr as soon as possible, so that an amicable solution can be sought.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, where the consumer Customer has sent a written complaint to the Provider and has not received a satisfactory reply — or in the absence of a reply within two months — they are entitled to use, free of charge, a consumer mediator with a view to the amicable resolution of the dispute, within a maximum of one year from their written complaint.

Recourse to mediation is optional and free of charge; the Customer remains free to accept or refuse it and, failing an amicable settlement, to bring the matter before the competent courts.
14. Personal data
The Customer's personal data is processed in accordance with the GDPR for the purposes of managing the booking, payment and customer relationship. The details and how to exercise your rights are set out in the Privacy policy.
15. Governing law and disputes
These T&Cs are governed by French law. Failing an amicable settlement, any dispute falls within the jurisdiction of the French courts. The consumer may bring the matter, at their choice, before any of the courts with territorial jurisdiction within the meaning of the Code of Civil Procedure, including the court of their place of residence.
